These terms are an agreement between you and Samipan Bandyopadhyay ("we", "us"), who develops and operates Fitto AI (the "App") and this website. By using the App or the website you agree to them. If you do not agree, do not use the App.
1. Apple's license agreement
The App is licensed to you under Apple's Licensed Application End User License Agreement. These terms add to that agreement. If the two conflict, Apple's agreement applies to the license to use the App.
2. Not medical advice
Calorie, macronutrient, calorie target and weight projection figures in the App are estimates, produced partly by artificial intelligence, and can be wrong. They are for general wellness and information only. They are not medical, dietary or nutritional advice and are not intended to diagnose, treat or prevent any condition. Talk to a doctor or registered dietitian before changing your diet, especially if you are pregnant, under 18, have a medical condition, or have a history of disordered eating. The App is not intended for children under 16.
3. Your account
You are responsible for keeping your sign-in details secure and for activity on your account. Give accurate information when you create it. You can delete your account at any time as described on the account deletion page.
4. AI credits and purchases
- Some features, such as photo, voice and text analysis, use AI credits. Free credits may be granted at sign-up or as rewards, and their amounts can change for new accounts.
- Credit packs are one-time, non-subscription purchases processed by Apple. Prices are shown in the App Store before you buy.
- Credits have no cash value, cannot be transferred or exchanged, and are lost when an account is permanently deleted.
- Refunds are handled by Apple under its policies at reportaproblem.apple.com.
- If an analysis fails, the App lets you retry or returns the credit, as described in the support page.
5. Acceptable use
Do not misuse the App. That includes trying to access other users' data, interfering with or overloading the service, reverse engineering it except where the law allows, creating accounts to collect free credits or referral rewards you are not entitled to, or uploading unlawful content. We may suspend or close accounts that break these rules, and remove credits obtained through abuse.
6. Your content
You keep ownership of the photos, descriptions and data you submit. You give us permission to process them to provide the App, as described in the privacy policy, including sending meal photos you choose to analyze to Google's Gemini AI service.
7. Changes and availability
We may change, add or remove features, and we may update these terms. When we make a material change we will update the date on this page. The App is provided "as is" and may sometimes be unavailable.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for decisions you make based on estimates shown in the App. Our total liability to you is limited to the amount you paid for credits in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.
